Exclamation What to do if you're stopped by the police

I don't think any topic in this forum is discussed more than what a person should do during a contact with law enforcement. That makes sense, considering this is a board about engaging in an illegal activity. So I think it's only fitting that my one thousandth post here be about what rights a person has when dealing with the police.

It might be a wise use of your time to take a few minutes right now and review the following discussion. Also, please click the following link:

ACLU Bust Card

...print the card, and keep one in your car, purse, or wallet.

American Civil Liberties Union, "Know Your Rights: What To Do If You're Stopped By Police, Immigration Agents, or the FBI"

We rely on the police to keep us safe and treat us all fairly, regardless of race, ethnicity, national origin, or religion. The ACLU Bust Card provides tips for interacting with police and understanding your rights.

Note: Some state laws may vary. Separate rules apply at checkpoints and when entering the U.S. (including at airports).

YOUR RIGHTS
- You have the right to remain silent. If you wish to exercise that right, say so out loud.
- You have the right to refuse to consent to a search of yourself, your car, or your home.
- If you are not under arrest, you have the right to calmly leave.
- You have the right to a lawyer if you are arrested. Ask for one immediately.

YOUR RESPONSIBILITIES
- Do stay calm and be polite.
- Do not interfere with or obstruct the police.
- Do not lie or give false documents.
- Do prepare yourself and your family in case you are arrested.
- Do remember the details of the encounter.
- Do file a written complaint or call your local ACLU if you feel your rights have been violated.

IF YOU ARE STOPPED FOR QUESTIONING
Stay calm. Don't run. Don't argue, resist, or obstruct the police, even if you are innocent or police are violating your rights. Keep your hands where police can see them.
Ask if you are free to leave. If the officer says yes, calmly and silently walk away. If you are under arrest, you have a right to know why.
You have the right to remain silent and cannot be punished for refusing to answer questions. If you wish to remain silent, tell the officer out loud. In some states, you must give your name if asked to identify yourself.
You do not have to consent to a search of yourself or your belongings, but police may "pat down" your clothing if they suspect a weapon. You should not physically resist, but you have the right to refuse consent for any further search. If you do consent, it can affect you later in court.

IF YOU ARE STOPPED IN YOUR CAR
Stop the car in a safe place as quickly as possible. Turn off the car, turn on the internal light, open the window part way, and place your hands on the wheel.
Upon request, show police your driver's license, registration, and proof of insurance.
If an officer asks to look inside your car, you can refuse to consent to the search. But if police believe your car contains evidence of a crime, your car can be searched without your consent.
Both drivers and passengers have the right to remain silent. If you are a passenger, you can ask if you are free to leave. If the officer says yes, sit silently or calmly leave. Even if the officer says no, you have the right to remain silent.

IF YOU ARE ARRESTED
Do not resist arrest, even if you believe the arrest is unfair.
Say you wish to remain silent and ask for a lawyer immediately. Don't give any explanations or excuses. If you can't pay for a lawyer, you have the right to a free one. Don't say anything, sign anything or make any decisions without a lawyer.
You have the right to make a local phone call. The police cannot listen if you call a lawyer.
Prepare yourself and your family in case you are arrested. Memorize the phone numbers of your family and your lawyer. Make emergency plans if you have children or take medication.

See American Civil Liberties Union, "Know Your Rights: What To Do If You're Stopped By Police, Immigration Agents, or the FBI".

When the cop stops me I just tell them I am on the way to the Hospital with my pregnant wife. And when the cop says, "But sir there is no one else in the car."
I say, "OH MY GOD I forgot my wife!"

run like hell from the cops and go to the nearest store so, witnesses can see everything and this might stop polie brutally.. tell the cops you got the shits really bad and thats why you went to the store. At this point they don't want to touch you for fear you are going to shit all over the place. You was speeding in the first place due to the upset stomach and throw yourself on the ground in agony. Works every time.

Well, what to do when stopped by the police for prostitution depends on whether you're male or female.

If you're female, you immediately sell out all the Johns you've seen and cooperate with the cops to set up a sting by turning over your cell phone with everyone's number in it. How many news stories have we seen on this?

If you're male, you take your medicine by getting hauled off to jail, bailing out, then returning for a court date to pay your fine. Life goes on, it's not the end of the world. (although, it may be the end of your marriage)

Don't run from the police. If an officer tries to pull you over for a traffic stop it is ok to proceed to well lighted area but don't run. Slow down, let them know you realize they are back there. They may not like it and they may give you some grief about it when you do stop. If you are female and a cop tries to pull you over in a dark, isolated area, most will understand if you slow down but keep going to the nearest safe location. If you are ever afraid or worried that the person who is trying to pull you over is not a real police officer don't hesitate to call 911. There are some sickos out there who pose as LE and target female drivers. The 911 operator should be able to verify who is pulling you over.

I would dial my lawyer and hand my phone to the cop.

No, I wouldn't advise running from the police if you're stopped or using some ludicrous story about diarrhea. I surmise Anita was kidding, although I think her yuk-yuks belong in The Sandbox (buried very deeply), not here.

Not many, really, because it's very rare. The Laws are usually satisfied with busting one provider in a sting so everybody can pat themself on the back and say they're protecting us common folks. The plea bargain offer for a provider charged with plain-vanilla, first-offense prostitution with capable counsel is so lenient in north Texas (examples: diversion or time-served) that LE doesn't really have much leverage to get the girl to help them make other cases. Making cases from information from a provider or, worse, from aliases and numbers in her phone, is very difficult and nearly always not worth the bother.

If a hobbyist just goes to court and pays a fine he's a fool. He'll have a conviction - and a sex-related one at that - on his record for the rest of his life. If he doesn't plan in advance for the contingency of arrest - after all, in case I need to remind you, hobbying is illegal - and somehow his spouse, SO, employer, family, friends, etc., get wind of his arrest, he's worse than a fool. He's a complete, total shithead.

When I get pulled.. mostly for having a cover over my plate which is legal in some places while illegal in others I usually just smile a lot, tell them I didn't know, tell them you will get someone to help you unscrew 2 screws and act clueless. Works every time. I have actually had a cop send me flowers after pulling me over and getting my licence.
