I read that the governor gets to appoint somebody to fill the term. He is a democrat, so this shouldn't change the head count in the senate....but it may take a few weeks to get somebody appointed.
I predict a hotly contested race when it comes time to fill his term. He was an apparently unbeatable incumbent, and now the seat will be wide open...similar to Kennedy's seat.

I know I started the thread mentioning his party, that was just to grab attention. I am not speaking to you Crew in anyway, I just want those who post here to be respectful. for regardless of his political affiliations, his past or his work in the senate he has passed away and any wrongs which he may or may not have done will be judged by a higer court, as will any blessings which he may have earned. Gee I am sounding all preachy so I am going to quit talking LOL.

lacrew is correct. The individual state's legislature determines the method of succession when it comes to appointing a replacement for a Senator. As West Virginia uses gubernatorial appointment, and West Virginia's governor is a Democrat means that the likely replacement will be a Democrat. However, it is unknown if there will be an election to fill his seat prior to this seat's expiration, which is in 2012. It may be that there will be an election to fill the seat as soon as Nov. 2010, depending on West Virginia law. The Kennedy seat election was a result of the Massachusetts legislature requiring an election within six months of a seat being vacated.
I wonder if the coverage of Sen. Byrd's death will mention his affiliation with the KKK, which was, according to Sen. Byrd, was short-term and because of their anti-communist stance (plus the fact the Grand Wizard at the time encouraged him to run for public office)? Probably not on MSNBC.

Yes, my post came during DD's second post. However, I am wondering what was disrespectful in my post? It was a statement of senatorial succession and a comparison between WV and MA, plus a question if the obituary contains the dark side as well as the light side of this senator's life as covered by a mainstream media eager to make Democrats saintly (dead or alive).

Fritz the disrespect came from the fact that the only mention of the man or his accomplishments was his membership in the KKK. How come you did not make a comment when I commented on this membership 2 months ago. No you wanted to make sure to point out a negative about a Democrat. How come you did not mention all the years as the leader of the senate, or something positive?

West Virgina law calls for a special election to be held to determine a replacement if the current office holder has more than half the term remaining. As it is in this case. A special election will be held this November.

I'm getting conflicting information in the news, but the secretary of state for WV just announced that yes, there would be a special election...but it wouldn't be until 2012, because some filing deadline had passed. In the interim, the governor will appoint.

Because the MSM has provided all the positive information regarding Sen. Byrd's career. And, if I didn't comment about this 2 months ago, it may have been that I missed your posting, or the fact that he wasn't dead yet.
