But the ID is fake Lady or client under

Can they be held liable on the age part?

It doesn't matter what ID is presented, if she is underage, she is underage. Even with the drinking age being 21, you have to be careful, as some guys think that if she was served, everything is OK. Underage cannot consent to sex and you will get hammered in court.

for me anything under age 40 is under age

It always bothered me that you can legally bang a 17 year old (the age of consent in NY). But if you pay her for the privilege, you can take a heavy bust for prostitution with a minor.
