WTF humiliated by new California Law!

Now WTF cannot misclassify his employees as contractors and exploit them without it being obvious he is doing something horrible. Other states, hopefully Texas, will soon follow and put him out of business. By humiliating the labor scofflaw WTF, California has finally done something right.
SACRAMENTO, Calif. —
California's governor on Wednesday signed sweeping labor legislation that aims to give wage and benefit protections to rideshare drivers at companies like Uber and Lyft and to workers across other industries.

The closely watched proposal could have national implications as lawmakers, businesses and unions confront the changing nature of work and the rise of the so-called gig economy.

"California is now setting the global standard for worker protections for other states and countries to follow," Democratic Assemblywoman Lorena Gonzalez, the bill's author, said in a statement.

The legislation signed by Gov. Gavin Newsom makes it harder for companies to classify workers as independent contractors instead of employees, who are entitled to minimum wage and benefits like workers compensation.

So now Cali is looking to fuck up a cool service like Uber/Lyft, make it twice as expensive to catch a ride, and hurt the people trying to make a quick buck part time. Their pay is a contact between private individuals and none of Gavin Newsom’s, or anyone else’s, business.

It adds up to the drivers, otherwise they wouldn’t agree to the terms. It’s none of your, mine, and certainly not the government’s business to infringe on a contract made between two individuals. It’s nice that you tip, but has nothing to do with an overreaching government.

Exploitative employers such as WTF cheat employees by mislabeling them as contractors and through their treachery gain an unfair advantage over honest and ethical employers who treat their workers fairly.

It is a legitimate function of government to act as a referee and ensure everyone plays by the rules. Government powers should be as limited as possible but certainly we can't do without it because not every individual you meet will give you a fair exchange.

where law is murky, different treatments arise

what constitutes an employee has been derived from common law

and further fleshed out by court cases

if a worker has more characteristics of what the courts have held to be indicators of an employee than not, the worker is an employee

but enforcement is uneven and difficult

the primary word that indicates employee status is "control"

control the work time, control the task, control who can perform, etc

other factors are is there a risk of loss, provides own tools of the trade, has the right of substitution etc

haven't read what California has done but it does seem an overreach in regard to uber drivers, although I don't know the contractual arrangement uber and its drivers have

but it seems an uber driver has a risk of loss and provides the tools of their trade, I don't know what the company can demand in terms of work schedule

I treat my employees well and hate people who take advantage of their workers. I hate government intervention but sometimes it is needed.

Gummint has to be the referee when things go too far.

Usually Kalifornia is up to no good but in this case the cheaters need to be reigned in and the good employers who treat their workers fairly need support.
