Hur's report (Chapter 12.I.C. The evidence does not prove beyond a reasonable doubt that Mr. Biden willfully disclosed national defense information in the notebooks to his ghostwriter p 244) might be a good place to look for how Hur concluded Biden shouldn't be charged. Just seemed to me a better way to find out than "asking myself."

Benjamin Pierce, a retired lieutenant colonel, got seven years in prison for retaining info and communicating some of it to his Chinese girlfriend. Asia Janay Laverello, a DOD employee, got 3 months in jail for keeping some secret documents at home. State Department arms expert Stephen Jin-Woo Kim received 13 months in prison after sharing classified information from an intelligence report on North Korea with a Fox News reporter.

I suspect what Pierce did was more serious than anything Biden was up to. But I'm not sure about the rest.

It makes perfect sense to me, that Hur would use Biden's current mental condition as one of the reasons to justify not prosecuting him. You'd think a jury wouldn't want to convict a feeble-minded old man. So why waste the taxpayers' money?

Gen Petraeus not only walked away with classified information, he shared it with girlfriend. The girlfriend was writing a book about him.

Trump had bathrooms full of classified information that was stacked from the floor to the ceiling at the Mar-a-Largo.

Agreed, Trump’s violations were more egregious. Still I don’t think Biden, Trump or any of the others in my previous post except possibly Benjamin Pierce deserved jail time.

And as to the bathroom, that’s just a sign of a considerate host. I used to leave a Playboy magazine in my bathroom so guests could be entertained while taking a dump.

Biden is fit to stand trial. Hur did not want to press charges because he thought a jury would not convict an elderly man who is a little forgetful. This goes to lack of intent. Like HRC did not intend to have classified information that was NOT marked classified in her emails on her server that she got from her husband Slick Willie Clinton.
