technically there is no such thing as an "illegal expulsion".

the senate can expel members for any reason. last time they did this was in 1861-1862 when Senate expelled 14 democrats from the senate for supporting the confederacy. 1 was actually reversed posthumously.

there have been a bunch of expulsion proceedings that resulted in no expulsion. there was a proceeding that caught my eye which appeared to be similar to Judge Moore's case but in a different context.

1893 William N. Roach Democratic North Dakota Not expelled Charged with embezzlement; Senate determined that charges were too far in the past

this is going to get messy, if they follow thru this expulsion.

moore wins, and gets sworn in.

0. charges are filed and expulsion proceedings begin
1a. senate does not expel him -- charges are too far in the past.
1b. senate expels him.
2. new election has to be filed again
3. reappoints Luther Strange to Senate
4. Moore runs for Senate again.
