This may actually give you some legal leverage (even though you don't want to go down that road). If she owns the copyright, then she must have given you a license or limited license to use the photographs, something for which you paid. Now that you can't use them, she didn't really give you anything of value, so she charged you for a license you can't use.

If she did not give you a license, then the whole session was a sham. The way you talk about her, I doubt it since she seems to have such a reputable reputation.

In the end, your leverage is not nearly as much legal as it is in this community. If you made it well-known on the boards what happened, and that the photog refused to make it good, you might be able to dry up some of her business. Even the largest corporations respond to bad publicity.

What a shame, Tylor! I'm so sorry you're going through this.

You are certainly not starting any rumors about the photographer...I have heard negative feedback about her from every lady who I know who has shot with her since she became a hit. I don't want to get into any specifics but I know that she has treated her clientele in a very unprofessional manner time and time again. *sigh* of frustration as I feel somebody really needs to discuss her publicly and save other ladies from wasting their money as well. (She is amongst the priciest I know of, BTW, and I've worked with a few, including her.) She has been the elephant in the room for too long!

I don't hold a grudge toward the photog in question but bad practice is bad practice. That is why we have the BBB, Angie's List and other review boards. As charlestudor2005 said: protest, protest, protest.

You paid someone for photos of youf, but the photographer has the copyright and you didn't even get a license for the money you paid? What kind of deal is that? That makes no sense to me. Why would that be the arrangement? What did you pay for?

Absent that bizarre contract, you should have a claim against the photographer is she has not secured the appropriate permission from the hotel for you to use the pics you paid for. Given the description you gave, however, God only knows what the situation is. You definitely need to talk to a lawyer.

In most cases I'd agree with you -- if we were talking about serious money. The all in figure (including her own web development costs) cited is $4K*.

If she can reach an acceptable resolution with the photographer, why does she need to engage one of your colleagues?

By way of analogy, if I trip and skin my knee should I call 911, head to the ER and have it treated or pick myself up, clean the injury, dress it & get on with my life?

Are there not certain legal matters where competent individuals can do it themselves and save a fee? At some point shouldn't a rational individual do a cost/benefit analysis and decide retaining a lawyer doesn't make sense?

Is that a lawyer's default answer to everything?

My gosh! I'm so sorry you're going through this Taylor. I think that you should be refunded on your photo session because YOU weren't the one responsible for the location of the shoot. The photographer owns you an apology for this, my dear, in addition to refunding you your money back. Also, you should be reimbursed a free session (if you desire) worth the same amount of money you paid for the actually session.

The easiest and least stressful course of action might be to withdraw the photos in question and ask the photographer for a re-shoot equivalent to the one in question - in an approved location, of course. Photoshopping images to disguise the location could lonly prolong the issue.

Whoever has the legal upper hand here is going to be determined at the expense of the photographer and model.

Thank you for the kind offer.It is quite refreshing after my experiences with the past photographer,
I wanted to keep our problems private and resolve them in a private matter,which is why I did not ever mention her name publicly. I am absolutely stunned that she would not want to handle this situation in the same manner.
