Default Over 18, but under 21: Alcohol & underage

Question for SJ:

Provider is 19 years old. OK, prostitution is illegal, but we all agree it is hard to prove with out undercover operation, etc.

What if you provide alcohol to the provider and she is under 21?

I know hypothetical, but I can remember a stripper many years ago in Dallas who was 18, dancing, but I could only buy her soft drinks. What happens if you buy a bottle of champagne and she partakes?

Penalties for Providing Alcohol to a Minor

Adults and minors who give alcohol to a minor also face a stiff penalty. The punishment for making alcoholic beverages available to a minor is a class A misdemeanor, punishable by a fine up to $4,000, confinement in jail for up to a year, or both. Additionally, the violator will have his or her driver´s license automatically suspended for 180 days upon conviction.

Persons 21 or older (other than the parent or guardian) can be held liable for damages caused by intoxication of a minor under 18 if the adult knowingly provided alcoholic beverages to a minor or knowingly allowed the minor to be served or provided alcoholic beverages on the premises owned or leased by the adult.

Sale to a minor is a class A misdemeanor, punishable by a fine up to $4,000, confinement up to a year in jail, or both.

I have a minum age of about 30, so not for me. I actually saw something in a review about a guy providing a provider who claimed to be 20 with alcohol. Thought it might be worth highlighting the dangers to the guys who like em young.

Like SoulManIke said.. deal with older women and no problems of that nature

As hot as some of these 18 and 19 year olds look.. they are clueless about the world.... rarely do they have an idea as to what to really do BCD

I would like to toss out a thought... would anyone here be opposed to seeing a law passed that made it illegal for anyone under the age of 20 to perform in the adult industry (movies, strip clubs, even escorting)..

logic is simple for movies.

girl is 19, or NineTEEN she can make "Teen" movies in which the title sounds worse than it is.. you get busted with movies about TEENS... ok.. sure.. all of them are NINETEEN but the media won't mention that...

for stripping.. well if she is 20 she is still not old enough to drink but she is not a "teenaged stripper"

and for escorting... make the law so that if caught with a john or in a sting they get more punishment and no sympathy.

If a 18-19 year old wants big money right out of high school she best hope daddy has lots of cash and gives it to her, escorting should not be a career choice for an 18 year old..... I know there some that it would appear to be the only option to get out of a situation but at that age they should be thinking about college or some entry level job...

I always gift a 750ml of the spirit of the
young ladies choice- they love it.
It's an easy gift for the 18-20 yr babes.

If they get busted it's gonna be vice not TABC.
TABC generally isn't a part of the alphabet soup
of task force groups. In which case the vice assholes
will likely confiscate the liquor for the after raid party.

Drunk drivers come at any age... but if one was to look over the number of drunk drivers caught and their age.. I would suspect most would be under 30.

As for the adult lifestyle (hobbying, stripping, doing Adult movies etc) I think 21 is a good minimum age limit mainly it puts the lady outside the "teen" classification and more than likely she will be thinking more about the life ahead than partying..

That being said, the law should be written to be more harsh on a lady who is under the age limit for these activities so that it makes them think twice.... guys on the other hand will seek out strippers, escorts and porn movies... with a set age limit or 21, if a 19 year old guy solicits a 32 year old escort and say gets busted, HE gets more punishment than she does....

this won't slow down the hobbying, but it will thin out the ones who tend to screw it up.

I pretty much knew the answer to my question, was really wanting to raise awareness here. I appreciate Shea's initial response. Her explanation of her motivation was appropriate since it was suggested that it was much to do about nothing.

In any regards, my motivation about alcohol & under 21 providers was not prompted out of concern for drivers. Rather, it was pointing out that a simple crime of prostitution becomes a larger issue when other crimes are also committed. Read this post by our resident attorney for details:

In several threads over the years, I have voiced my humble opinion that LE does not invest much effort in the victimless crime of an independent woman having a financial arrangement with an indepedent man that involves sex. Where they get more involved is where other crimes occur, such as underage sex, drugs, pimps, agencies, or where there is high visibility such as AMPs, etc.

With that in mind, if LE found a number of cases of underage (under 21, but over 18) ladies getting their hands on alcohol, it might create more interest than any of us desire.

Taking Shea's comments along with my concerns a bit further, imagine if that 19 year old gets drunk, goes for a ride, kills an innocent person on the street, then confesses to LE that she received the alcohol in exchange for sex. LE will have no choice but to investigate fully and hang the perp who supplied the alcohol by his short hairs for all to see.

None of us need that kind of publicity. The more UTR this hobby flies, the less attention we draw and the more unfettered fun we can have.

I second what tigercat wrote.

I know, a seasoned hobbyist might not sweat bringing a girl he knows some alcohol, although she's not yet 21 years-old. I've certainly done that. But there's a risk, and it mainly stems from the fact that the provider and the alcohol may interact outside your presence, and therefore outside your control. So what you might have is a girl who may be lacking in common sense (no offense to our lovely ladies here, but that is a frequent trait of young providers) fueled with alcohol THAT YOU PURCHASED. Do you really want to release such a fury on society? Haha.

I don't tend to tell war stories, but I'll make an exception here to illustrate my point. About three years ago, a young provider I've known for four years (she's 22 years-old now) was gifted a bottle of Jagermeister. Although she was on probation for DWI (and had a number of priors for drugs), she drank the entire bottle in her incall and tried to drive home. When a cop tried to pull her over for speeding and weaving, she fled, fearful that CPS would take away her little bundle of illegitimacy. She crashed, damaging a house in her neighborhood. (You think I make this shit up?) When the detective told the girl she was facing pen time, she ratted out the hobbyist who gave her the Jager. The DA filed only a DWI first-offense and she avoided prison. The hobbyist, however, was only offered straight probation (not deferred), and now he has a permanent conviction on his record.

Again, my concern is not so much what a seasoned hobbyist might do in this situation. My concern is more for the novice hobbyist and, MUCH WORSE, for the hobbyist who THINKS he's seasoned but he's not. Please -- put your ego aside and put your safety first -- as well as the safety of the girl and the public at large. If you are not 100% POSITIVE a provider is of legal drinking age, then it's probably a very bad idea to fuel her with spirits.
