Default Federal Court to Hear NDAA Lawsuit Thursday

Well, the NDAA will be in court on Thursday. Opponents of the NDAA are not confident in the outcome, due to issues like standing. In order to have standing, a plaintiff must have suffered some harm from the act being enforced. Therefore, in order to have standing, one must have been detained under the Act. Uh oh. If you are detained under the act, you have no right to counsel or a probable cause hearing. So, when you have standing to oppose the NDAA, you are detained without a right to counsel, and no right to appear in court. The action that allows you to get into court is the same action that will prevent you from being heard in court.

That's some catch, that Catch-22.

The Court doesn't have to rule against the entire bill, in fact, I don't think the entire bill is in question. Just Sections 1031 and 1032.
