To be clear, no one, and certainly not the judge in this case, is saying "to let them stay in America forever." He is saying that everyone is entitled to due process before deportation, but especially if it involves being transported to a prison in a country other than their own. MAGA is making up its own rules, many of them unlawful.

I actually have some legal precedent that will refute your argument that these pieces of shit deserve due process under our laws in this country. I’m not in the mood nor have the time at the moment, I’m cooking dinner, but there is a decision by SCOTUS (can’t remember the name of the case at the moment, but read about some of it earlier) from the early 1900’s, around WWI I believe it was, that stated this is the law of the land….. The Alien Enemies Act of 1798. And no judge has the right to dispute it. Please read the following quote from the actual law:

“The president may invoke the Alien Enemies Act in times of “declared war” or when a foreign government threatens or undertakes an “invasion” or “predatory incursion” against U.S. territory.”

Take note to the most important “or”: “predatory incursion”

And btw, Woodrow Wilson (WWI) & FDR (WWII), both Lib Dems, both invoked The Alien Enemies Act during peacetime prior to Congress actually “declaring war”.

I think you are correct in describing the members of the Tren de Aragua as "pieces of shit." They are a violent criminal gang.

However, the Tren de Aragua is not "a terrorist organization," which is what the Trump administration claims. "By definition, terrorists are people who use criminal violence to further an ideological aim, seeking to coerce changes in policy. Tren de Aragua is clearly a dangerous criminal organization, but ....is not motivated by any particular ideology as it pursues human smuggling, kidnapping for ransom and drug trafficking. Rather, its agenda seems to be reaping illicit profits."

Even scumbags and violent criminals are entitled to due process.

Trump has tried a very clumsy move to justify his unlawful deportation by invoking the Alien Enemies Act of 1798. But that law applies "only to hostile acts perpetrated by enemy nations and commensurate with war and is not relevant to illegal immigration or non state actors like criminal gangs."

Until the courts review and rule upon the claims of the Trump administration, the legality of this deportation is in question. The judge should not be threatened with impeachment. As Chief Justice Roberts has written in his rebuke to Trump, rulings can be appealed, but you can't attack judges that issue rulings you don't agree with.
